Rulemaking and Order Making have different purposes. Yet, when one or the other is more appropriate has been subject to considerable debate except for the most clearly defined cases.
Directions:
In this discussion forum, provide remarks which differentiate rulemaking from order-making in the context of their relative strengths and weaknesses. What special challenges exist for selecting one or the other? Is there something about order-making that makes it incompatible with efficiency standards? Keep in mind that the idea of administrative agency efficiency is a function of expeditious actions that are not always inherent in many traditional governmental bureaucratic organizations.
